Conservatorship Law - a specialty of San Diego Elder Law Center
Conservatorship: when a person is appointed by the Court to care for someone who cannot handle their own financial matters or take care of themselves physically.
If a person suffers from an incurable disease, is involved in a debilitating accident, or is too aged and infirm to manage their own affairs, state law might require the to court appoint a conservator. The conservator is given the authority to make financial decisions and handle the financial affairs, under court supervision, of a person who lacks the capacity to manage on their own. The conservator must make periodic reports to the court, and petition the court for additional authority under certain circumstances. Typically, the conservator is paid for their services, and there may be attorney fees as well. In addition, the court sometimes requires a conservator to purchase a "surety bond", which is a type of insurance policy, to protect the estate of the conservatee. The costs and expenses of a conservatorship are paid by the estate.
We at San Diego Elder Law Center help Senior Citizens in matters of conservatorship, estate planning, Medi-Cal, disabilities, special needs trusts, power of attorney, probate, and more. We are in San Diego, California.
